Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cap That mobile app and related services (the "Service") provided by Cap That Game ("Cap That", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA/UK) to use the Service. By using the Service, you represent that you meet this requirement.

2. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us promptly at support@playcapthat.com if you suspect unauthorized access.

3. Acceptable Use

When using the Service, you agree not to:

• Submit captions or upload images that are illegal, hateful, sexually explicit, harassing, defamatory, or violate the rights of others.
• Attempt to bypass content moderation or automated safety systems.
• Scrape, reverse-engineer, or interfere with the Service's normal operation.
• Use the Service to harass or threaten other players.
• Impersonate another person or misrepresent your identity.

We may remove content, suspend, or terminate accounts that violate these rules, at our sole discretion.

4. User-Generated Content

You retain ownership of the captions and images you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and transmit that content solely to operate the Service (for example, to show your caption to other players in your game).

5. Third-Party Meme Content

Memes served during gameplay may be sourced from third-party providers. We do not own that content and make no representations about it. If you believe content in the Service infringes your rights, please contact us.

6. In-App Purchases

The Service offers optional paid features, including Cap That Pro, sold through Apple's App Store or Google Play. Purchases are subject to the applicable store's terms. All purchases are final except where required by law or the applicable store's refund policy.

7. Service Changes & Availability

We may modify, suspend, or discontinue any part of the Service at any time. We are not liable for any resulting loss of gameplay progress, user content, or purchases beyond what is required by law.

8. Termination

You may stop using the Service at any time and request account deletion. We may suspend or terminate your account if you violate these Terms or if your continued use would pose a risk to us or other users.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, Cap That will not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to the Service. Our total liability for any claim shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold Cap That harmless from any claim or demand arising out of your content, your use of the Service, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Cap That Game is established, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by updating the date above. Continued use of the Service after changes take effect constitutes acceptance.
